If stopped for a DUI, it is important that you be aware of your legal rights.

Don’t answer any questions- You have the right to remain silent. If you talk, you waive this right and anything you say can be used against you. Be cooperative and police to the officers. Do not answer any questions in regards to the events prior to your stop, what you have had to drink, where you are coming from, where you are going, and all other questions asked by law enforcement.

Don’t admit to drinking- You might think being polite and honest to the officers will help your case, when in reality it can damage your case. And in most instances, when you are nervous; you never say anything how you intend to. You might try to say “I haven’t had a lot to drink” and instead say “I didn’t drink the whole 18 pack”. These statements can damage your case and will be included in your police report, the judge and jury will be informed of your statements. In fact, the prosecutor uses your statements as part of meeting it’s burden of proof.

Ask to speak with an attorney immediately- Upon being arrested you should immediately ask to speak with an attorney. What are the procedural rights?

There are certain procedural rights that law enforcement must follow such as:

1. You should be advised of the reasoning for the traffic stop, and there must be sufficient facts to constitute a “probable cause” stop.

2. The law enforcement officer should advise you that you are not required by law to complete and/or perform any field sobriety tests or portable breath tests.

3. Immediately after being arrested, you should be read your Miranda rights before any further questioning.

4. If asked to perform a breath or blood test and you refuse, the law enforcement officer should notify you of your legal consequences.
